DMCA Copyright Policy

Stickery.ai respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, we have implemented the following policy to address claims of copyright infringement regarding user-generated designs.

1. Notice of Copyright Infringement (Takedown Notice)

If you are a copyright owner or an agent thereof and believe that any user-generated content hosted on Stickery.ai infringes upon your copyrights, you may submit a written notification pursuant to the DMCA by providing our Designated Copyright Agent with the following information in writing:

  • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  • Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works.
  • Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, along with information reasonably sufficient to permit us to locate the material (e.g., the specific URL or design ID on Stickery.ai).
  • Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an email address.
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

3. Counter-Notification Procedures

If a user’s design is removed or disabled due to a DMCA notice, and the user believes the material is not infringing (or that they have the right to use it), the user may send a Counter-Notification to our Designated Agent. This counter-notice must contain:

  • The user's physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
  • A statement under penalty of perjury that the user has a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • The user's name, address, and telephone number, and a statement that the user consents to the jurisdiction of the Federal District Court for the judicial district in which the address is located (or Oregon, if the address is outside the United States), and that the user will accept service of process from the person who provided the original notification.

If a valid counter-notice is received, Stickery.ai may send a copy to the original complaining party. Unless the copyright owner files an action seeking a court order against the content provider within 10 to 14 business days, the removed material may be replaced or access to it restored at our discretion.

4. Repeat Offender Policy

In accordance with the DMCA and other applicable laws, Stickery.ai maintains a strict policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are deemed to be repeat infringers. We also reserve the right to limit access to the platform or terminate the accounts of any users who infringe upon the intellectual property rights of others, whether or not there is any repeat infringement.
