1. Acceptance of Terms

By accessing and using Stickery.AI ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Age Requirements

You must be at least 18 years old to create an account, use the Service, generate sticker designs, place orders, or make purchases through Stickery.AI. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. The Service is not intended for children under 13, and we do not knowingly collect personal information from children under 13.

3. Service Description

Stickery.AI is an AI-powered design and manufacturing service that generates custom sticker designs and manufactures high-quality physical stickers. Our service includes AI-powered design generation, manufacturing services, and order fulfillment.

4. Content Policy and Prohibited Uses

You agree not to use our service to generate, create, or request designs that contain:

• Profane, vulgar, or obscene content
• Violent imagery, weapons, or graphic content
• Hate speech, discriminatory content, or content promoting violence against individuals or groups
• Copyrighted material without proper authorization
• Trademarked logos or brand names without permission
• Content that impersonates or misrepresents affiliation with any person or entity
• Content that violates any applicable laws or regulations
• Content intended to harass, bully, or intimidate others

We reserve the right to refuse service, block requests, or terminate accounts that violate these content policies.

5. Account Restrictions and Termination

We may restrict, suspend, or terminate your account for the following reasons:

• Violation of our content policy
• Abuse of our service or resources
• Attempting to circumvent our security measures
• Providing false or misleading information
• Engaging in fraudulent activities
• Violation of applicable laws or regulations
• Repeated violations of these terms

6. Appeals Process

If your account has been restricted or terminated, you may appeal the decision by:

1. Contacting our support team at support@stickery.ai
2. Providing a detailed explanation of why you believe the action was taken in error
3. Including any relevant evidence or context
4. Demonstrating understanding of our policies and commitment to compliance

We will review your appeal within 5 business days and provide a written response. Our decision on appeals is final.

7. Intellectual Property Rights

You retain ownership of the final image file provided to you through our service, subject to these terms. You have the right to download, use, and create derivative works from the returned image file for your personal or commercial purposes.

To the extent permitted by applicable law, Stickery.AI grants you full rights to use, reproduce, display, distribute, and commercially exploit the final image file provided to you through the Service, subject to these Terms. However, because some designs may be generated in whole or in part by artificial intelligence, Stickery.AI makes no representation, warranty, or guarantee that any AI-generated design will qualify for copyright, trademark, or other intellectual property protection, or that you will be able to register, enforce, or claim exclusive rights in any such design.

We retain ownership of all print files, manufacturing files, and production specifications created during the manufacturing process. These files are proprietary to our manufacturing process and are not provided to customers.

You may use the returned image file to create your own print files, manufacturing files, or other derivative works for your own production needs. However, you may not reverse engineer or attempt to recreate our manufacturing processes based on the products you receive.

You represent and warrant that you have the right to create the content you generate and that it does not infringe on the rights of any third party.

8. Commercial Resale and Due Diligence

If you choose to commercially resell, distribute, or otherwise monetize the physical stickers or digital designs generated and manufactured through Stickery.AI, you do so entirely at your own risk.

1. User Due Diligence: You acknowledge and agree that it is your sole responsibility to conduct all necessary due diligence prior to the commercial resale of any products obtained through our Service. This includes, but is not limited to, verifying that the designs do not infringe upon any third-party intellectual property rights, including copyrights, trademarks, and patents, and ensuring that the physical products comply with all applicable local, state, federal, and international laws, safety standards, and regulations required for your specific market or use case.
2. Disclaimer of Liability for Resale: Stickery.AI explicitly disclaims any and all liability related to your commercial resale activities. We are not liable for any third-party claims of intellectual property infringement, loss of anticipated profits, business interruption, product liability claims, or any other legal or financial consequences resulting from your distribution or sale of the stickers.
3. Resale Indemnification: In addition to the general indemnification obligations outlined in these Terms, you specifically agree to indemnify, defend, and hold harmless Stickery.AI, its officers, directors, employees, and agents from and against any and all claims, damages, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your commercial resale, marketing, or distribution of products manufactured or designed through our Service.

9. Community Sharing, Credits, and Rewards

Designs you create on Stickery.AI are private by default. You may optionally share eligible designs to the community marketplace so other users can view them and order physical stickers of those designs. Community sharing is a privilege, not a right, and is subject to these Terms and our related guides.

1. Eligibility and Agreement: To share a design, you must accept our community sharing agreement (where prompted) and confirm that you have the rights needed to share the design. Shared designs must comply with these Terms, our Community Guidelines, and all applicable laws. Stickery.AI may screen, delay, deny, remove, or unpublish shared designs, and may limit or revoke community-sharing privileges at any time.
2. License to Display and Fulfill: By sharing a design to the community, you grant Stickery.AI a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and use that design as reasonably needed to operate the community marketplace and to manufacture and fulfill orders placed by you or other users for physical stickers based on that design. This license continues for as long as the design remains available for community viewing or fulfillment of related orders.
3. Your Responsibilities: You are solely responsible for designs you share. You represent that shared designs do not infringe copyrights, trademarks, publicity rights, or other rights of any third party. You agree to indemnify Stickery.AI for claims arising from designs you share, as further described in these Terms and our Community Guidelines.
4. Sharing Consequences: Once a design is approved and shared, other users may view it and purchase physical stickers of it. Certain features may be unavailable for shared designs (for example, enhancement). Removing or deleting a shared design may be limited by platform features, pending orders, or moderation requirements. Stickery.AI does not guarantee that a design will remain available, featured, or discoverable.
5. Credits Generally: Credits are a limited, non-transferable platform benefit used to generate and iterate on designs in the Service. Credits have no cash value, are not a bank deposit or stored-value account, and are not redeemable for cash except where required by law. Physical sticker orders are paid separately and do not spend generation credits.
6. Earning Credits from Orders: Subject to these Terms and program rules shown at the time of purchase, you may earn credits when you complete qualifying paid STICKERLY™ sticker orders (for example, credits based on amounts spent on eligible orders after payment). Current earning details may be described on our Pricing and FAQ pages and may change from time to time.
7. Community Purchase Rewards: If you share a design to the community and another user later purchases physical stickers of that shared design in a qualifying order, you may earn community reward credits. Rewards are typically granted on a per-design, per-order basis for purchases by other users (not for purchases of your own shared designs by you). Reward amounts, timing, eligibility, and caps may change. Credits may not post immediately after a purchase and may be withheld, reversed, or adjusted for cancellations, refunds, chargebacks, fraud, abuse, moderation removals, or policy violations.
8. Credit Expiry: Credits roll over and expire twelve (12) months after the date they are issued, including credits from packs, subscriptions, order rewards, community rewards, promotions, and other grants, unless a different expiry is expressly stated for a specific offer. Expired credits are forfeited and are not reinstated. We may apply credits in an order that uses older credits first.
9. No Earnings Guarantee: Stickery.AI does not guarantee that shared designs will be viewed, purchased, or generate any credits. Community rewards are promotional platform benefits, not wages, royalties, equity, or payment for goods sold by you as a seller of record on a third-party marketplace.
10. Changes and Abuse: We may modify, suspend, or discontinue community sharing, credit earning rates, credit packs, subscriptions, reward programs, or expiry rules at any time. We may investigate and take action against abuse, including denying rewards, removing content, restricting accounts, or terminating access.

10. Shipping, Returns, and Refunds Policy

Because Stickery.AI products are custom printed and manufactured based on user-generated designs, all sales are final except where a product is defective, damaged, or otherwise materially incorrect due to an error by Stickery.AI.

1. U.S. Shipping Only: We ship physical STICKERLY™ orders within the United States only. You must provide a valid U.S. shipping address.
2. No Cancellation After Placement: Because production begins automatically when a physical sticker order is placed, you may not cancel a physical order after checkout. Review your order carefully before purchasing.
3. Custom Goods and Design Satisfaction: We do not offer refunds, returns, or exchanges because you do not like the AI-generated design, color, scale, style, wording, or appearance once printed, unless the delivered product is defective or materially different from the order specifications we accepted.
4. Damaged or Defective Orders: If your stickers arrive damaged, defective, or with a manufacturing error, contact us promptly with your order information and clear photos of the issue. At our discretion, we may offer a replacement, store credit, or refund for the affected items.
5. Lost Packages: If a package appears to be lost in transit, we may ask you to work with the shipping carrier and provide reasonable information needed to investigate the shipment. Replacement or refund eligibility for lost packages will be determined at our discretion based on the carrier status, tracking information, and order details.
6. Incorrect Shipping Addresses: You are responsible for providing a complete and accurate shipping address at checkout. Stickery.AI is not responsible for orders that are delayed, lost, returned, or delivered incorrectly because you provided an incomplete, outdated, or incorrect address. Additional production or shipping costs caused by incorrect address information are your responsibility.

11. Payments, Taxes, and Billing

Payments for orders, credit purchases, subscriptions, and other paid features are processed by Stripe or its affiliates. By submitting payment information or completing a purchase, you agree to pay all charges shown at checkout, including product charges, shipping charges, taxes, fees, and any other applicable amounts.

Stickery.AI does not store full credit card numbers, card security codes, or other sensitive payment card data on our servers. Payment information is collected and processed by Stripe according to Stripe's applicable terms and policies, including the Stripe Privacy Policy and the Stripe Services Agreement.

1. Taxes and Fees: You are responsible for all applicable taxes, duties, fees, and governmental charges associated with your purchase, whether collected at checkout or assessed later by a carrier, government authority, or other third party.
2. Billing Authorization: You represent that you are authorized to use the payment method provided and authorize Stickery.AI and Stripe to charge that payment method for the amounts due.
3. Billing Disputes: If you believe a charge is incorrect, contact us promptly so we can review the issue. Filing a chargeback or payment dispute without first attempting to resolve the issue with us may result in suspension or termination of your account, cancellation of pending orders, or restriction of future purchases, to the extent permitted by law. 4. Failed Payments: If a payment fails, is reversed, or is disputed, we may delay fulfillment, cancel the affected order, suspend paid features, or seek collection of amounts owed.

12. Force Majeure

Stickery.AI is not responsible or liable for any delay, failure, interruption, loss, or damage caused by events outside our reasonable control. This includes, but is not limited to, natural disasters, severe weather, fires, floods, pandemics, labor disputes, postal or carrier delays, supply chain disruptions, equipment failures, power or internet outages, acts of government, war, civil unrest, or other circumstances beyond our control that affect design generation, manufacturing, fulfillment, or shipping.

If a force majeure event affects an order or the availability of the Service, we may delay, suspend, modify, or cancel affected services or orders as reasonably necessary.

13. Disclaimers and Limitations

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the service will be uninterrupted, secure, or error-free. We are not responsible for any damages resulting from the use of our service.

14. Limitation of Liability

IN NO EVENT SHALL STICKERY.AI BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, INCURRED BY YOU OR ANY THIRD PARTY, WHETHER IN AN ACTION IN CONTRACT OR TORT, ARISING FROM YOUR ACCESS TO, OR USE OF, THE SERVICE.

Our total liability to you for any claims arising from the use of our service shall not exceed the amount you paid for our service in the 12 months preceding the claim.

15. Indemnification

You agree to indemnify and hold harmless Stickery.AI, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the service or violation of these terms.

16. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the service, to understand our practices.

You may receive transactional emails related to your account, orders, billing, and security as part of using the Service. Separately, if you opt in, we may send marketing emails, including reminders about items left in your cart. Marketing emails are optional and may be stopped at any time through account preferences or the unsubscribe link in those emails. Details are in our Privacy Policy.

17. Modifications to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion, without prior notice. Any changes will be effective immediately upon posting the revised Terms on this page, and the "Last updated" date at the top will be updated accordingly. Your continued use of the Service following the posting of any changes constitutes acceptance of those modified terms.

18. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of Oregon, without regard to its conflict of law provisions.
